Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lead Sniper website at leadsniper.us and the Lead Sniper software platform (collectively, the "Service"), operated by the Blue Collar Billion Network ("Lead Sniper," "we," "us," or "our"). By accessing the Service or submitting a territory availability request, you agree to be bound by these Terms.

1. Eligibility and Accounts

The Service is intended for use by roofing and home-service businesses. You must be at least 18 years of age and authorized to enter into agreements on behalf of the company you represent. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account and those of your sub-users.

2. Subscription, Fees, and Billing

Lead Sniper is offered on a monthly subscription basis. Beta Founding Member pricing is $999.99 per month plus a one-time $499 concierge setup fee. The setup fee is charged at onboarding and covers configuration of your branded application, campaign design, and training. Subscription fees are billed monthly in advance and are non-refundable except as required by law.

Beta Founding Member pricing remains in effect for as long as your subscription remains continuously active and in good standing. If your subscription lapses, is cancelled, or is suspended for non-payment, founding-member pricing is forfeited and any subsequent subscription will be billed at the then-current standard rate.

3. Lead Allowance

Each subscription includes an allowance of up to 80 leads per month, where a "lead" means a property submitted through the application that is successfully skip-traced and enters a direct-mail and nurture campaign. Unused allowance does not roll over between billing periods. Additional leads beyond the monthly allowance may be available at additional cost.

4. Territory Exclusivity

Subject to your subscription remaining active and in good standing, we grant you exclusivity within an approximately 20-mile radius of the primary service address associated with your account. During that period we will not knowingly onboard another roofing company whose primary service address falls within that radius. Exclusivity applies to the assigned radius only and terminates automatically upon cancellation, non-payment, or termination of your subscription, at which point the territory becomes available to other applicants.

5. Acceptable Use

You agree that you will not, and will not permit your users to:

• Use the Service in violation of any applicable law, including telemarketing, direct mail, data privacy, and consumer protection laws
• Contact consumers who have opted out, revoked consent, or are otherwise not permitted to be contacted
• Misrepresent your identity, credentials, licensing, or insurance to any property owner
• Resell, sublicense, or provide access to the Service to any third party without our written consent
• Attempt to reverse engineer, scrape, or interfere with the operation or security of the Service

You are solely responsible for the content of the messaging, offers, and representations you make to property owners through the Service, and for compliance with all applicable regulations governing your marketing activity.

6. Third-Party Services

The Service integrates third-party providers for property data, skip-tracing, print and mail fulfillment, communications, scheduling, and payment processing. Your use of the Service is also subject to the availability and terms of those providers. We are not liable for interruptions, inaccuracies, or delays caused by third-party providers, carriers, or the United States Postal Service.

7. No Guarantee of Results

Any figures presented on our website or in our marketing materials — including lead volume, appointment rates, close rates, revenue, and return-on-investment illustrations — are estimates provided for illustrative purposes only. They are not guarantees, projections, or warranties of the results you will achieve. Actual results depend on your market, pricing, sales team, responsiveness, and execution.

8. Intellectual Property

The Service, including all software, designs, trademarks, and content, is and remains the exclusive property of Lead Sniper and the Blue Collar Billion Network. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription term. You retain ownership of your own logos, brand assets, and customer data, and you grant us a license to use those assets solely to operate the Service on your behalf.

9. Cancellation and Termination

You may cancel your subscription at any time, effective at the end of the then-current billing period. We may suspend or terminate your access immediately for non-payment, breach of these Terms, or conduct that exposes us or property owners to legal risk. Upon termination, your territory exclusivity ends and campaign automation ceases.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that property data will be complete or accurate in every instance.

11. Limitation of Liability

To the maximum extent permitted by law, Lead Sniper and the Blue Collar Billion Network will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or lost business opportunities, arising out of or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount of subscription fees you paid to us in the three months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Sniper, the Blue Collar Billion Network, and their officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your marketing content, your communications with property owners, or your breach of these Terms.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be reflected by the "Last updated" date above and, where practicable, communicated by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. The state and federal courts located in Erie County, New York will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
